Jurisdictio, The Right to the Free Development and Recreational Use of Tetrahidrocannabiol

Article refer to the debate about marijuana from the emission of the court decision 237/2014, it reflects on cannabis and the content of the judgment that allows the “recreational” use of cannabis for claimants under stands, highlight some issues like the right to free development of personality. Some problems for the judgment commented: his liberal ideology, the abandonment of the content of Article 73, section XVI, of the Constitution and in particular, the possible construction of a negative right “to no personality development”, the “objective” responsibility of the user of marijuana and the right to the “protection of health”.
